Terms & Conditions

This is an agreement between Threshold Agency LLC d/b/a Threshify (“Threshify”) and the business(es) or individual(s), having accepted Threshify’s Terms & Conditions.

If a Client chooses to sign up for a membership, their username and password can only be used by that individual registrant for one apartment community. If the username and password are shared with anyone else that gains access to Threshify, that sharing is a material breach of this Agreement. The Client is responsible for managing their account and ensuring its privacy and protection. If you need assistance with that, please contact support@threshify.com. We reserve the right to delete or change your Password, Sign-In Name, or Unique Identifier at any time and for any reason and shall have no liability to you for any loss or damage caused by such action.

All templates, designs, ideas, products and Threshify-owned stock photography are licensed solely for use at the Client’s community while a member of Threshify. Likewise, any guest account that utilizes our system is bound to the same rules and conditions set forth about our templates, designs, ideas and products. Sharing of any content with another community for use online or offline will result in immediate membership termination and related legal courses.

CREATIVE PROJECTS

REVISIONS AND ALTERATIONS

Client revisions to specifications and deliverables resulting in increased time will be billed at current standard hourly rates. Client will be notified of additional fees resulting from revisions or alterations prior to performing the requested revision.

PRODUCTION SCHEDULES AND EXPEDITING

Proposed fees and production schedules are based on the work being performed within our employees and third-party service provider’s standard work week schedule. If production schedules are not adhered to by Client, final delivery date or dates will be adjusted accordingly. Additional fees may be incurred by and billed to the Client when Client delays or requests to expedite completion require work to be performed outside of the standard work week Client will be notified of additional fees resulting from delays or expediting prior to performing the work.

NATURE OF COPY

Client agrees to exercise due diligence in its direction to Threshify regarding preparation of materials and must be able to substantiate all claims and representations as to Client’s legal rights to trademark, service-mark, copyright and patents. Client is responsible for all trademark, service-mark, copyright and patent infringement clearances. Client is also responsible for arranging, prior to publication, any necessary legal clearance of materials we prepare. Threshify makes no representations nor accepts any liability for materials provided to Threshify by Client.

ERRORS AND OMISSIONS

It is Client’s responsibility to check proofs carefully for accuracy in all respects, ranging from spelling to technical illustrations. Written or via email approval of Client or Client’s authorized representative is required on all mechanicals or artwork prior to release for printing or other implementation. Threshify is not liable for errors or omissions.

SAFEGUARDING OF CLIENT PROPERTY

Threshify will take all reasonable precautions to safeguard the property you entrust to us. Except in the case of gross negligence on our part, we are not responsible for loss, destruction or damage or unauthorized use by others of such property.

SUPPLIER’S PERFORMANCE

Threshify is not responsible for failure on the part of third parties providing services or products used on behalf of Client projects.

GRANTS OF USE

Upon the purchase of any creative from Threshify, the unique username associated with an apartment community is automatically granted use of the creative for their own purposes in any format they deem appropriate. The Grants of Use does not provide ownership rights to the community. Any breach of this will result in immediate termination of membership and potential legal action.

You may not reproduce, resell, reuse, or otherwise take advantage of the creative work Threshify provides.

PREPAYMENT AND COMMENCEMENT OF SERVICES

Production will commence after receipt of payment of invoice.

REJECTION OF PROJECT

If, prior to completion of the project, the Client observes any non-conformance with the design plan, Threshify must be promptly notified, allowing for necessary corrections. Client agrees to submit its reasons for rejection of the completed project in writing or via email to Threshify. Client remains responsible for all costs incurred in conjunction with the project.

CANCELLATION OF PROJECT

Cancellation of a project, along with reasons for cancellation, must be made in writing. Client will be billed for work performed prior to the date of cancellation and cancellation is subject to a cancellation fee equal to 10% of the total cost.

PAYMENT TERMS

BILLING CONTACT INFORMATION

Client will provide a valid billing contact, address and email and will notify Threshify promptly upon any changes thereto by emailing support@Threshify.com.

PAYMENT METHOD, CURRENCY AND TAXES

All prices are based on a payment method of check, credit card or electronic funds transfer. All payments under this Agreement shall be made in US dollars. Except for taxes on Threshify's income, Client is responsible for paying all applicable sales, use or other taxes or duties, tariffs, etc. applicable to the services provided.

GENERAL

Client shall bear all costs, expenses, and reasonable attorney’s fees in any action brought to recover payment under this contract or in which Threshify may become a party by reason of this contract.

Client agrees and understands that Threshify may change the fees and standard labor rates upon thirty (30) days prior written notice.

The validity and enforceability of this agreement will be interpreted in accordance with the laws of the State of Texas applicable to agreements entered into and performed in the State of Texas. This agreement is our entire understanding and may not be modified in any respect except in an executed agreement. Any dispute concerning or arising from this agreement or its interpretation shall be resolved exclusively in either the state court system for Texas located in Travis County, Texas or the Federal District Court for the Western District of Texas, Austin Division and the parties hereby consent to the exclusive jurisdiction and venue of such courts.

RETURN POLICY

If you’re looking to return or exchange your order for whatever reason, we're here to help! We offer returns or exchanges within 10 days of product receipt for printed items that arrive damaged. Please take a picture of the package and the included material in order to receive a replacement order at no additional charge to you. We do not offer returns on digital files you create and download on your own.

If your items are damaged upon receipt and you don’t want a replacement, you can return your product for store credit, a different product, or a refund to the original payment method.

Below are some examples of common exceptions:

Discounted items are final and cannot be returned or exchanged
Returned items must be returned in original product packaging

To initiate a return or exchange, please complete the following steps:

Login to our online return portal using your email address and order ID.
Choose the products you wish to return or exchange from your order.
Print the prepaid shipping label that you will receive by email.
Send all items back to us using the label provided.
